SmartBark Academy Terms of Service Effective Date: 01.01.2025

1. Acceptance of Terms By accessing or using SmartBark Academy's website and services ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree, please do not use the Platform.

   2. Services Provided SmartBark Academy provides online dog training courses, materials, webinars, and related services. Details of services are described on the Platform.

   3. Eligibility & Accounts - You must be at least 18 years old (or have parental consent if younger). - You may need to register and create an account with accurate, up-to-date information. - You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

   4. License & Intellectual Property - We grant you a limited, non-exclusive, non-transferable licence to access and use the Platform content for personal, non-commercial purposes. - All material (text, images, videos, etc.) remains our (or our licensors') property and is protected by copyright and trademark law. - You may not reproduce, distribute, modify, or create derivative works without our express permission.

   5. User Conduct When using our Platform, you agree to: - Act lawfully and responsibly. - Not infringe any rights of third parties or disrupt the Platform. - Refrain from uploading harmful content (viruses, spam, hate speech).

   6. Payments, Refunds & Fees - Paid courses and services are advertised with fixed prices. - Payments are processed securely via third-party providers. - Refunds will be handled per our Refund Policy. - All fees are non-refundable unless explicitly stated.

   7. Subscriptions & Renewals If you enrol in a subscription-based course, it may renew automatically. You can cancel at any time via your account to avoid future billing.

   8. Privacy Our Privacy Policy explains how we collect and use your data. By using the Platform, you consent to such processing.

   9. Disclaimer & No Guarantees - The Platform is provided "as is" and "as available" without warranties of any kind. - We don't guarantee specific results from training; success depends on you and your dog. - We disclaim liability for access interruptions, errors, or third-party content.

   10. Limitation of Liability To the fullest extent permitted by law, SmartBark Academy is not liable for indirect, incidental, special, or consequential damages. Our total liability is capped at the amount you paid us in the preceding 12 months.

   11. Indemnification You agree to indemnify and hold SmartBark Academy harmless from all liabilities, damages, and expenses arising from your breach of these Terms, misuse of the Platform, or violation of any law.

   12. Termination We reserve the right to suspend or terminate your access at any time for breach or misuse. You may cancel your account at any time through your account settings.

   13. Governing Law & Dispute Resolution. These Terms are governed by English law. Any disputes will be resolved by the courts of England and Wales.

   14. Changes to Terms We may update these Terms occasionally. When we do, we'll post the new version with a revised "Effective Date." Continued use of the Platform signifies acceptance of the updated Terms.
